Terms of Service

By accessing or using the ScentAura AI mobile application ("App," "Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Agreement to Terms

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use ScentAura AI. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. License and Access

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

3.2 Restrictions

You agree not to:

• Modify, reverse engineer, or decompile the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or data
• Share your account credentials with others
• Create multiple accounts to abuse features or bypass limitations
• Use automated tools (bots, scrapers) to access the App
• Interfere with or disrupt the App's functionality
• Violate any applicable laws or regulations

4. Account Registration

4.1 Account Creation

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage from unauthorized account use.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, abuse the App or other users, or remain inactive for an extended period (we will notify you first where reasonable).

5. App Features and Services

5.1 Fragrance Tracking

The App allows you to:

• Track your fragrance collection
• Log daily wear and usage
• Record compliments and notes
• View fragrance statistics and insights

5.2 AI Recommendations

We provide AI-powered fragrance recommendations based on your profile information, local weather conditions, your fragrance collection, and usage patterns and history.

Recommendations are suggestions only and may not suit everyone. We are not responsible for any adverse reactions, allergies, or dissatisfaction with recommended fragrances.

5.3 Aura Score

The "Aura Score" is a gamified metric based on time elapsed since application, your routine completion, and fragrance longevity data. It is for entertainment and motivation purposes only and does not guarantee actual scent projection or effectiveness.

5.4 Location Services

If you enable location access, we use your location to provide weather-based recommendations. Location data is used in real time and not permanently stored. You can disable location access at any time.

5.5 Notifications

With your permission, we may send daily spray reminders, reapplication alerts, and important account or service updates. You can disable notifications at any time through the App settings.

6. User Content

6.1 Your Data

You retain ownership of all data you input into the App, including fragrance collection details, personal profile information, usage logs and notes, and your preferences and settings.

6.2 License to Use Your Data

By using the App, you grant us a limited license to store and process your data to provide the Service, use anonymized, aggregated data for analytics and improvements, and generate AI recommendations based on your profile. We will not sell your personal data, share identifiable information without consent, or use your data for purposes beyond providing the Service.

6.3 Data Deletion

You can delete your account and all associated data at any time through Profile → Delete Account. Upon deletion, your data will be permanently removed within 30 days.

7. Intellectual Property

All content, features, functionality, and design of the App are owned by ScentAura AI and are protected by copyright, trademark, and other intellectual property laws.

"ScentAura AI," our logo, and related marks are trademarks of ScentAura AI. Fragrance names, brands, and related imagery belong to their respective owners.

8. In-App Purchases

We may offer premium features or subscriptions available for purchase through the App Store (iOS) or Google Play Store (Android). All purchases are processed by Apple or Google. We do not store your payment information, and refunds are subject to their policies.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings. We may also offer free trials; if you do not cancel before the trial ends, you will be charged for the subscription.

9. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE." We do not guarantee uninterrupted or error-free operation, accuracy of recommendations or information, suitability for your specific needs, or compatibility with all devices.

We are not responsible for allergic reactions, skin irritation, or other health issues related to fragrance use. Always test fragrances before full application and consult a healthcare professional if you have sensitivities or concerns.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, data, use, or goodwill; service interruptions or data loss; or actions of third-party services. Our total liability will not exceed the amount you paid us in the last 12 months (if any).

11. Indemnification

You agree to indemnify, defend, and hold harmless ScentAura AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms, misuse of the App, violation of any third-party rights, or content or data submitted to the App.

12. Third-Party Services

We use third-party services such as Clerk (authentication), Supabase (database), OpenAI (AI recommendations), Google Gemini (AI analysis), Open-Meteo (weather), and SerpApi (fragrance search). Your use of the App is also subject to their terms and privacy policies.

13. Changes to the App & 14. Changes to Terms

We may modify, suspend, or discontinue features; update the App; change pricing; or impose usage limits. We may also update these Terms from time to time. Changes are effective when posted in the App, and your continued use constitutes acceptance.

15. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or harmful activity, or abuse the App or other users.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Before filing a lawsuit, you agree to attempt to resolve disputes through good-faith negotiation by contacting us at supportteam@scentaura.app.

If a dispute cannot be resolved informally, you agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Miami, Florida, USA, and you consent to the personal jurisdiction of those courts.

17. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScentAura AI. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision does not waive our right to enforce it later.

19. App Store and Google Play Terms

If you download the App from the Apple App Store or Google Play Store, you acknowledge that these Terms are between you and ScentAura AI, not Apple or Google. Neither Apple nor Google is responsible for the App or its content, has any obligation to provide support, or is liable for any claims related to the App.
